Aircraft operated on a UK Permit to Fly were, until recently, not allowed to be flown solely on instruments or at night, whereas some of the same types, built as US experimental aircraft have been doing so for years. Moreover, some orphaned aircraft which had previously been cleared for night/IMC operations lost that freedom on transferring to the Permit-to-Fly scheme. The team of Mike Andrews; Mike Barnard, Steve Noujaim, Peter Pengilly and Nick Sibley approached the CAA to obtain an easement of this restriction and have negotiated a procedure whereby individual permit aircraft may be given exemption from this restriction. They have put in a considerable amount of work to satisfy the CAA that this could be safely done and to devise a satisfactory process to allow such clearances to be given.
